Terms and Conditions of Sale

All claims and returned goods must be accompanied by our invoice. Advance permission must be obtained to return parts. All returned parts are subject to a 25% handling charge. No goods returnable after 14 days. No returns will be accepted on electrical merchandise.

Any amount in arrears shall be paid upon demand together with a charge computed at 1 ½% per month (but if said percent is greater than the lawful maximum, then the lawful maximum rate) on the outstanding monthly balance being the equivalent of an ANNUAL PERCENTAGE RATE of 18% (or lawful maximum). Customer agrees to pay all costs of collection, including reasonable attorney's fees, which are incurred by the vendor or assigns for collection of any monies due under this agreement or for any goods or services received by the customer from the vendor which are not fully paid within 30 days.

All rights and obligations of the parties hereto shall be governed by the Uniform Commercial Code as enacted and in force in the Commonwealth of Massachusetts on the date of this invoice, and that any dispute concerning this invoice or merchandise represented thereby may be resolved, both as to jurisdiction and venue, in any court in Norfolk County, Massachusetts.

Should any dispute involve more than one invoice or delivery of merchandise, the terms herein shall apply to the entire account. The customer authorizes the vendor to waive service of process in any action at law or equity to enforce the terms of this agreement; provided that the vendor sends by registered mail at least 7 days before the day of entry of such action a notice of his intention to enter same on said day.

Customer agrees to notify vendor within 5 days of address change. The customer hereby grants a security interest to Autopart International Inc., in all goods that it has sold or may sell and the proceeds thereof, as collateral security for the payment of all the customer's obligations to Autopart International, Inc. presently existing or hereafter arising.

The customer hereby represents that any goods sold, or matters related thereto, are for business purposes, not personal, family or household purposes, and as such M.G.L. Ch. 93C does not apply in any way whatsoever to this transaction or matters related thereto.

Part numbers supplied to us or used by us shall identify a part size and/or application only and shall not be considered to represent any particular brand, supplier or distributor. If a particular brand or supplier is required, please specify same in writing at time of purchase.

Any shipping claims for loss or damage must be made against the carrier by the buyer.
